1. Eligibility: This giveaway is open only to those Facebook and Instagram users who have “followed” Mitsubishi Fuso Truck and Bus Corporation (“MFTBC”) on Facebook or Instagram and added a “comment” to the MFTBC photo posted on Facebook (available at URL: Giveaway Post 1 or Giveaway Post 2) or Instagram (available at URL: Giveaway Post) specifying their favorite MFTBC truck. No purchase is necessary to enter or win, and a purchase does not increase the chances of winning. This giveaway is subject to all applicable local laws in the territory of any participants, and is void where prohibited by law (including, but not limited to, in any countries where use of Facebook or Instagram is prohibited) or where prior governmental registration, permission, and/or license is required. MFTBC may at any point, at its sole discretion, cancel the giveaway at any time.

2. Agreement to Rules: By participating, the Contestant (“You”) agree to be fully, unconditionally bound by these Terms & Conditions, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of MFTBC as final and binding as it relates to the content and outcome of this giveaway.

3. Campaign Period: All participants must have met all requirements and completed all actions, as specified herein, for entry into the giveaway by 1PM JST, December 20, 2020 in order to be eligible. Giveaway winners will be individually contacted by MFTBC. MFTBC reserves the right to select and award alternate winners in the event no response is received by initial or earlier selectees. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of MFTBC.

4. Prizes: The winner(s) of the Campaign (the “Winner”) will receive a small, scale model kit of an MFTBC truck, with the model to be decided at MFTBC’s sole discretion. A total of three (3) model kits to three different Winners will be awarded in this giveaway. No cash or other prize substitution shall be permitted. The prize is nontransferable. Any and all prize-related expenses, including without limitation, any and all local taxes, shall be the sole responsibility of the respective winners. Acceptance of a prize constitutes permission for MFTBC to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation to the fullest extent allowed by applicable law.

5. Winner Selection and Notification: Winners will be randomly selected. Each Winner will be individually notified by MFTBC through Facebook or Instagram, depending upon the platform the Winner has used to make the winning entry, within five (5) days following selection, and may be requested to provide additional information that may be required in order for MFTBC to complete the prize transfer. MFTBC shall have no liability for Winner’s failure to receive notices due to spam, junk e-mail, or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. If Winner cannot be contacted, is ineligible, fails to claim the prize within 5 days from the time award notification was sent, or fails to timely return any completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected. Receipt by Winner of the prize offered in this giveaway is conditioned upon compliance with any and all applicable laws and regulations. It shall be the responsibility of each participant who may be contacted by someone claiming to be from MFTBC in connection with this giveaway to confirm the identity of any such contactor prior to taking any action that may be requested.

6. Limitation of Liability: By entering, You agree to release and hold harmless Facebook, Instagram, MFTBC, and MFTBC’s subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such entrant’s participation in the giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof.

7. Disputes: This giveaway shall be governed by the law of Japan, without respect to any applicable conflicts of laws doctrines. As a condition of participating in this giveaway, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this giveaway, shall be resolved individually, without resort to any form of class action, exclusively before Tokyo District Court. Furthermore, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this giveaway). Participant further waives all rights to have damages multiplied or increased.

キャンペーン利用規約

1.  応募資格：本キャンペーンには、FacebookまたはInstagramで三菱ふそうトラック・バス株式会社(「MFTBC」)を「フォロー」し、FacebookまたはInstagramに投稿されたMFTBCの写真(Facebook: キャンペーン投稿1またはキャンペーン投稿2)(Instagram: キャンペーン投稿)に、お気に入りのFUSOトラックの名称を「コメント」したユーザーのみが応募することができます。応募または当選するために商品またはサービスの購入は必要なく、購入しても当選する確率は変わりません。本キャンペーンは、応募者に適用される現地の法律の定めに従うものとし、法律で禁止されている場合(FacebookまたはInstagramの利用が禁止されている国を含む)、または政府機関の登録、許可、ライセンスが必要な場合には無効となります。MFTBCは、自らの裁量により、いつでも本キャンペーンを中止することができます。

2. 同意：本キャンペーンに応募することにより、応募者（「利用者」）は、本利用規約に無条件に従うものとします。また、利用者は、本キャンペーンの内容と結果に関するMFTBCの決定を最終的かつ法的拘束力のあるものとして受け入れることに同意するものとします。

3. キャンペーン期間：応募者は、応募資格を得るためには、2020年12月20日午後1時（日本標準時）までに本利用規約に定める条件を全て満たす必要があります。当選者にはMFTBCから個別にご連絡させていただきます。当選者からお返事がいただけなかった場合には、MFTBCは代わりの当選者を選び、賞品を授与する権利を有します。不備のある応募、またはルール、指定に従っていない応募は、MFTBC自らの裁量により失格とする場合があります。

4. 賞品：本キャンペーンの当選者（「当選者」）には、MFTBCが裁量により決定するFUSOトラックのプラモデルキットが贈呈されます。本キャンペーンにより、3名の当選者に合計3つのプラモデルキットが贈呈されます。現金またはその他の賞品による代替は致しかねます。賞品は譲渡できません。各地の税金を含む賞品に関連するあらゆる費用は当選者が負担するものとします。賞品の受領により、MFTBCが法で認められる範囲で広告または商業的目的のために当選者の氏名、肖像、記入事項を無償で使用することを承諾したものとみなします。

5. 当選者の選択と当選の通知：当選者は無作為に選択されます。各当選者は、選択から5日以内に応募方法に応じてFacebookまたはInstagramを通じてMFTBCから個別の通知を受け取り、賞品の贈呈のために必要な情報の提供を求められる場合があります。当選者によるスパムメール、迷惑メール等のセキュリティ設定により当選者に通知が届かなかった場合、また当選者が提供した連絡先情報が誤っていたあるいは利用不能となっていた場合、MFTBCは一切の責任を負わないものとします。当選者が連絡不能な場合、応募資格がない場合、当選の通知が送信されてから5日以内に賞品の送付を希望しなかった場合、規約を遵守する旨の誓約書の提出を求められたにも関わらず応じなかった場合、賞品は没収され、代わりの当選者を選択する場合があります。当選者が本キャンペーンの賞品を受領するにあたっては、適用されるすべての法律及び規制を遵守する必要があります。当選者は、本キャンペーンに関してMFTBCを名乗る者から連絡があった場合に、その要求に応じる前に、各自の責任でかかる連絡者の身元を確認するものとします。

6. 免責：応募により、利用者は、Facebook、Instagram, MFTBC、MFTBCの子会社、関連会社、広告代理店、パートナー、代表者、代理人、承継人、譲受人、従業員及び役員が、応募者のキャンペーンへの参加、賞品またはその一部の受領、所有、使用または誤用により、過失の有無に関わらず、直接的または間接的に発生する可能性のある責任、病気、傷害、死亡、訴訟、請求、損害について一切の責任を負わないことに同意するものとします。

7. 紛争解決：本キャンペーンは抵触法の原則に関わらず、日本法を準拠法とします。応募者は本キャンペーンに参加する条件として、当事者間で解決できない紛争、本キャンペーンに起因または関連する請求権について、いかなる形態の集団訴訟に頼ることなく、個別に東京地方裁判所を専属的合意管轄裁判所として解決することに同意します。また、かかる紛争が生じた場合、いかなる場合においても応募者は応募者が実際に負担した費用（本キャンペーンへの応募に伴う費用）を除き、妥当な弁護士費用を含む懲罰的、偶発的、または結果損害についての賠償を認められずあらゆる権利を放棄するものとします。応募者は、賠償額を乗じ、または増加させる権利を放棄するものとします。
